Refund & Cancellation Policy

This Refund & Cancellation Policy explains your rights and obligations when purchasing Services from MyWritingTutor (“we”, “us”, “our”).
It is written in accordance with the Australian Consumer Law (ACL).

Our Services include:

  • NAPLAN-aligned writing lessons and courses
  • Membership and subscription-based access
  • Digital downloads
  • AI-generated writing assessments and progress reports
  • Trial writing assessments
  • Parent-managed student accounts

By purchasing our Services, you acknowledge and agree to our Terms & Conditions, including the incorporated AI Disclosure & Parental Consent Policy.


1. Your Rights Under Australian Consumer Law

Under the ACL, you are entitled to a remedy (refund, repair, or replacement) if the service:

  • Is not delivered with reasonable care and skill
  • Does not match the description
  • Is not fit for purpose

However, the ACL does not provide refunds if:

  • You change your mind
  • Your child loses interest
  • You select the wrong course
  • You fail to use the service during the subscription period
  • You no longer want AI-assisted feedback (unless this makes the service unusable)

We follow the ACL in full.


2. Digital Content & Immediate Access

Most MyWritingTutor products provide instant access upon purchase, including:

  • Lessons
  • Worksheets
  • Writing prompts
  • AI feedback tools
  • Course content
  • Trial submissions
  • Membership bundles

Because digital content cannot be “returned”, we do not provide refunds after access is granted unless required by the ACL.


3. Refunds for Courses & Memberships

3.1 Change-of-mind refunds

Not offered for digital educational content.

3.2 Incorrect purchase

If you purchase the wrong Year level or course, we can transfer you to the correct one within 7 days.
Refunds are not issued for such errors once access is unlocked.

3.3 Non-delivery or technical failure

You may be eligible for a refund if:

  • You cannot access the purchased content due to a platform error
  • The system fails in a way that prevents delivery
  • We cannot resolve the issue within a reasonable time

We will first work to resolve the issue before considering a refund.


4. Refunds for AI-Assisted Assessments

AI-generated assessment is a core component of MyWritingTutor.

Refunds are provided only if:

  • The assessment is never delivered
  • A major platform error makes the assessment unusable
  • Delivery fails due to our system error

Refunds are not provided if:

  • You disagree with the AI feedback
  • You expected a different score
  • Your child does not like the comments
  • The writing sample did not follow instructions
  • Variability occurs between assessments (normal with AI models)

Parents agree to AI processing through the required consent checkbox at checkout.


5. Subscriptions & Recurring Payments

5.1 Cancellation

You may cancel your membership at any time.
Cancellation stops future billing but does not entitle you to a refund for time already used.

5.2 Access after cancellation

Your access continues until the end of the current billing cycle.

5.3 Failed payments

Access may be paused until payment details are updated.


6. Trial Assessments

Our trial assessments involve:

  • A writing submission
  • AI-generated feedback
  • A parent report
  • A call-to-action to purchase a course

Refunds are not offered for trial submissions once the AI or system begins processing the writing sample.


7. Promotional Bundles, Discounts & Special Offers

Promotional prices and bundles:

  • Are non-refundable
  • Cannot be partially refunded
  • Cannot be transferred
  • Must be purchased again if cancelled

8. AI Consent & Refund Implications

AI-based assessment is central to the functionality of MyWritingTutor.

Because the system relies on AI:

  • Withdrawing AI consent may make some services unusable
  • No refunds are available if you withdraw consent after access to content has been granted
  • You may cancel your membership if you no longer wish to use the service

This is consistent with ACL rules for digital services where functionality depends on consent.
